AGGRESSIVE DRIVING IN MARYLAND
Aggressive driving is a common traffic ticket issued in Maryland, and it’s defined by Transportation Article 21-901.2 as:
“A person is guilty of aggressive driving if the person commits three or more of the following offenses at the same time or during a single and continuous period of driving in violation of:
- § 21-202 of this title (Traffic lights with steady indication);
- § 21-303 of this title (Overtaking and passing vehicles);
- § 21-304 of this title (Passing on right);
- § 21-309 of this title (Driving on laned roadways);
- § 21-310 of this title (Following too closely);
- § 21-403 of this title (Failure to yield right-of-way); or
- § 21-801.1 of this title (Exceeding a maximum speed limit or posted maximum speed limit)”.
Aggressive driving in Maryland is a very serious charge, for if you are convicted of this offense, five points will be assessed on your Maryland driving record, or potentially more than five points if you possess an out of state learner’s permit, provisional license, driver’s license, commercial learners permit, or a commercial driver’s license; if the charge is alleged to have contributed to a vehicular accident, then being convicted of this offense, or even being given a probation before judgment, may raise a prima facie case of liability in a subsequent civil suit. Marylands Ticket Fighter, LLC, can really help you fight an aggressive driving charge, since law enforcement officers usually write tickets for this offense based on what they deem to be aggressive driving, meaning that defendants facing this charge often weren’t breaking at least three of the traffic laws as defined above; law enforcement officers often think that a high speed alone, or that following too closely by itself is aggressive driving as defined by Maryland law, when in fact this is incorrect. So if you are charged in Maryland with aggressive driving, whether it’s connected to a vehicular accident or not, you should hire Marylands Ticket Fighter, LLC, as there is potentially a lot that we can do for you, including, but not limited to, having a trial, potentially having the law enforcement officer and judge dismiss the charge before trial, amending the aggressive driving charge to a different offense, or otherwise working out a different pre-trial disposition. If this charge goes to trial, then Marylands Ticket Fighter, LLC, can assist in your defense, as certain testimony would have to be given proving that you drove your vehicle in such a statutorily prescribed manner as to constitute the offense of aggressive driving.
