
BENCH WARRANTS AND QUASHING
FAILURE TO COMPLY (“FTC”),
FAILURE TO APPEAR (“FTA”),
AND FAILURE TO APPEAR BENCH WARRANTS AND QUASHING
If you receive Maryland non-jailable traffic tickets, you have thirty days to either pay the tickets, request a waiver hearing, or request a trial. You should almost always request a trial within this thirty day period instead of paying the tickets or requesting a waiver hearing on them, for if you pay the tickets you plead guilty and will receive all of the driver’s license points/FMCSA safety score points, and if you request a waiver hearing you plea guilty ahead of time and the law enforcement officer who wrote you the tickets will not be present in Court. If you neither pay the tickets, request a waiver hearing, or request a trial within the 30 day period from when you received your tickets, then Maryland will automatically suspend your Maryland driver’s license/driving privilege; if you have an out of state driver’s license, then Maryland will immediately tell that state to suspend your driver’s license, and which your home state is obligated to do. If your tickets are marked failure to comply, you need to call Marylands Ticket Fighter, LLC, immediately, so that we can try to have your case set for trial, and which will lead to Maryland automatically withdrawing your driver’s license suspension/driving privilege suspension. If you fail to appear in Court for the trial or waiver hearing regarding your Maryland non-jailable tickets, then Maryland will again immediately either suspend your driver’s license/driving privilege, or they will instruct your home state to immediately suspend your driver’s license. When a trial date is finally set in your Maryland non-jailable traffic case, Marylands Ticket Fighter can appear on your behalf so that you don’t have to attend court.
If you fail to appear in Court for a Maryland jailable traffic case, then in all likelihood the judge will issue a warrant for your arrest, while Maryland will also immediately suspend your driver’s license/driving privilege, or Maryland will request that your home state suspends your driver’s license. If you fail to appear in a Maryland court for your jailable traffic case and a warrant is then issued for your arrest, then the best course of action is that you quickly hire Marylands Ticket Fighter, LLC, to file what is called a motion to quash, and which is a request of the court who issued the warrant to recall the warrant and to also recall your driver’s license/driving privilege suspension. Some jurisdictions in Maryland may also criminally charge you for failing to appear in court for a jailable traffic case.
