
DRIVER/VEHICLE EXAMINATION REPORTS
Certain law enforcement personnel are able to write Driver/Vehicle Examination Reports, including Maryland Transportation Authority Officers, local police officers, and Maryland State Troopers. Under federal law, someone driving a commercial motor vehicle (a “CMV”), can be pulled over at anytime, and regardless of whether the law enforcement officer has “reasonable suspicion” that the driver of the CMV is breaking any law. Sometimes during these stops, or during interaction with law enforcement at a weigh station or at a truck stop, the law enforcement officer will complete what is known in Maryland as a Driver/Vehicle Examination Report, and which is actually not a ticket, meaning that, unless corresponding tickets are given by the law enforcement officer, that the driver has no right to fight the allegations listed on the Driver/Vehicle Examination Report in Court. If no ticket is given corresponding to what is on the Driver/Vehicle Examination Report, or if tickets are given for what is on the Driver/Vehicle Examination Report, then the driver is looking at getting FMCSA safety score points, or the owner-operator under their federal department of transportation number is looking at getting the FMCSA safety score points. However, many times the law enforcement officer does issue tickets that correspond with the Driver/Vehicle Examination Report, and if so, these tickets should be fought in Court, as if the driver is found not guilty, or if the charges are amended to certain other offenses, then the owner-operator of the DOT number will not get the FMCSA safety score points, and the driver will not get any points on their driving record.
