
MARYLAND TRAFFIC TICKET APPEALS
If you’re found guilty of traffic tickets in Maryland, then you have four general options on what to do:
- Accept the verdict.
- File a motion for a new trial within 10 days of the verdict.
- File an appeal within 30 days of the verdict.
- File a motion to modify/revise/reconsider the judgment within 90 days of the verdict.
In my eleven years of practicing law, I have never seen a motion for new trial granted, primarily because you’re asking the judge who just ruled against you to hear your whole case a second time. Filing a motion to modify/revise/reconsider the verdict is sometimes a good idea, but filing this does not hold (“toll”), the thirty day period to file an appeal if this motion isn’t granted or if it doesn’t work out as you had hoped. So in many Maryland traffic matters, filing an appeal may be a great decision.
There are many reasons why filing an appeal in your Maryland traffic matter could make sense. The court filing fee is only $80, though you should hire an attorney and will have to pay for our services (and which are usually higher than our fee for a district court case). The appeal will move your case from the district court to the county’s circuit court, where you will get a brand new trial, where very little from the district court case will matter, and where you will appear before a different judge than the judge that you had in district court. Further, a prosecutor will appear on behalf of the state in the appeal, where in many instances in Maryland there is no prosecutor for your district court traffic case (especially in non-jailable traffic matters); having a prosecutor for your traffic appeal, and especially for non-jailable traffic cases, is often very helpful, as they don’t like doing non-jailable traffic cases and as they will often bend over backwards to resolve your case favorably. Also, filing an appeal of your Maryland traffic case will give you time to accomplish things that you may not have done for your district court traffic case, such as getting a valid license, valid insurance, valid registration, or taking driving improvement courses.
